Brave Texas Mothers Fighting Against Immigration Oppression

Who amongst us believes that the Texas State Department of Health has the knowledge, ability or right to determine who should or should not be a citizen of the United States? We respect the Department of Health. We believe they are incredibly important, insofar as the public health of the residents of our state is concerned. However, we find it outrageous and a little bit ludicrous that the Health Department has seized the power to decide against the 14th amendment of the United States Constitution in their current bid to deny babies their right to birth certificates, based solely on the location where their parents were born.

Since 2013, hundreds and possibly thousands of babies have been denied their birth certificates because their parents could not produce the correct identification, according to the current requirements that don’t follow the U.S. Constitution.  In other places in the US and before 2013 in Texas, babies who were born in the United States were granted citizenship. The 14th amendment, in fact, guarantees this right. However, after President Obama began pushing for expanded rights for immigrants in 2013, the Texas State Department of Health pushed back in their much more stringent identification requirements.

Fortunately, there are brave women who are standing up to this injustice. They have filed a lawsuit against the Texas State Department of Health, fighting the denial of their children’s legal right to obtain citizenship of the United States.

The women in the lawsuit were in possession of the proper identification – official IDs issued by foreign consulates. However, they did not possess legal residency documents, which the Health Department erroneously insisted that they needed.

Most likely, many of these women came to the United States – at incredible risk to themselves and their children – specifically because they wanted to provide their children the best possible future by gifting them with United States citizenship. These women may never get rich or get ahead in life because of the sacrifices they have made to get to the US. They probably work in low-paying jobs and barely pay the bills each month, enduring great stress to simply get by. But they do this in order to give their babies a shot at a real opportunity to do better for themselves.
